1. Introductory provisions

These contract terms apply to stays in the accommodation facility “Glamping tents” in the enclosed resort Nová Rabyně, Rabyně 32, 252 08 Rabyně. The parties to the contractual relationship are the accommodation provider on one side and the customer who books the stay on the other. Both natural and legal persons may become a customer (hereinafter the “customer”). The customer named in the contract represents all participants of the stay, is entitled to act on their behalf and is the only person responsible towards the accommodation provider.

By confirming the booking in the accommodation facility, the customer agrees to these contract terms.

2. Formation of the contractual relationship

The contractual relationship between the customer and the accommodation provider arises when the customer confirms the booking of a glamping tent located in the enclosed resort Nová Rabyně, Rabyně 32, 252 08 Rabyně in the online booking system and pays the deposit/full amount for the accommodation as stated in Article 3, point 3.4 of these contract terms. In exceptional cases, when the customer has no internet access, the booking can be made by telephone.

The customer and the accommodation provider agree to the use of postal or electronic (e-mail) communication. Notifications made in either of these ways are recognised by both parties as valid written notifications.

3. Price of the stay and payment terms

Unless otherwise agreed in a written contract between the accommodation provider and the customer, the customer is obliged to pay a deposit of 50% of the price of the stay within 5 days of the date the booking confirmation is sent from the online booking system of the glamping tent to the customer's account. The accommodation provider takes care to remedy reported defects without undue delay and is obliged to keep the accommodation premises in proper technical and hygienic condition.

The accommodation provider has the right to inspect the accommodation premises in the presence of the customer after the end of the customer's stay. We ask customers not to regard this as a sign of distrust. Thank you for your understanding.

The accommodation provider is not liable for harm to the health (or damage to the property) of customers caused by their carelessness, inattention, negligence, improper use or poor supervision.

6. The stay

The customer has the right to use the premises intended for accommodation as well as the common areas of the facility. At the beginning of the stay the customer receives a key. The customer is obliged to return this key to the accommodation provider no later than at the end of the stay. The customer must prevent the loss or theft of this key and must not lend it to persons not accommodated in the facility. In the event of loss, theft or misuse of the key, the customer is obliged to pay the accommodation provider a contractual penalty of CZK 1,000; this does not affect the accommodation provider's right to claim compensation for the damage caused.

The accommodation provider checks the customer in between 15:00 and 19:00 on the day of arrival and the customer is obliged to leave the facility no later than 10:00 on the day of departure. The exact check-in time on the given day is agreed by telephone between the customer and the accommodation provider.

If the customer does not comply with this time, the price for an additional day of stay will be charged according to the valid price list.

It is forbidden for the entire capacity of a glamping tent to be used only by minors under 18 years of age or only by persons with limited legal capacity. When accommodating persons under 18 years of age or persons with limited legal capacity, at least one responsible supervisor over 18 years of age must be present for the entire stay.

6.3. Energy and savings
In the interest of saving energy and thus being considerate to the environment, we ask you not to leave the air conditioning running when you are not in the accommodation. Given the nature of the accommodation, 15 minutes are enough to reach the desired temperature.

6.4. Pets
Staying in or visiting the facility with pets is possible provided the conditions below are met.

The dog (or other animal) must be well behaved, must not scratch the furniture or lie on the beds or upholstered furniture.

The dog owner will supervise its behaviour so that the equipment of the facility is not damaged. If equipment is damaged, the dog owner is obliged to pay for the damage.

The owner will provide a bed, a food bowl and a water bowl for the dog from their own resources, not from the equipment of the facility.

The dog owner is obliged to pick up after their dog.

6.5. Storage of sports equipment
The customer is not allowed to bring into the facility sports gear and items for which another storage place is designated.

7. Changes to the contract and withdrawal from the contract

If the accommodation provider is forced, for objective reasons, to change the essential terms of the contract before the start of the stay, it may propose a change of the contract to the customer. In such a case the customer has the right to agree to the change or to withdraw from the contract. If the customer does not withdraw by written notice within 10 days of receiving the proposed change, the customer is deemed to agree to the change.

The customer has the right to withdraw from the accommodation contract.

The accommodation provider has the right to withdraw from this contract if the customer grossly violates the obligations set out in this contract or the accommodation rules, or grossly violates good morals in the facility.

Withdrawal from this contract must be in writing and is delivered to the other contracting party. Withdrawal from this contract does not affect the obligation to pay claims arising from this contract before the withdrawal or cancellation fees.

Withdrawal from the contract is governed by the following cancellation conditions, which determine the amount of the cancellation fees:

  • more than 30 days before the start of the stay – no fee
  • 29 – 15 days before the start – 30% of the price of the stay
  • 14 – 8 days before the start – 40% of the price of the stay
  • 7 – 4 days before the start – 60% of the price of the stay
  • 3 days or less – 80% of the price of the stay
  • No-show – 100% of the price
  • Early termination of the stay – 50% of the unused services

The stated percentage of the cancellation fees is calculated (a) in the event of withdrawal before the start of the accommodation or no-show, from the accommodation price, (b) in the event of early termination of the accommodation, from the arranged and unused accommodation services.

In justified cases (illness, death in the family, force majeure, etc.) the cancellation fee may not be charged, based on the decision of the accommodation provider.

In the event of withdrawal from the accommodation contract, the accommodation provider is entitled to ask the customer to vacate the accommodation premises immediately and leave the facility, and the customer is obliged to comply with this request without delay.

8. Complaints

The customer is obliged to make any complaint immediately after discovering the defect, to the accommodation provider or the responsible person of the accommodation provider, so that it can be remedied.
